Welcome to our terms and conditions of use (the “Terms”). Please read them and our Privacy Policy carefully.

1. THE PLATFORM

These Terms cover the use of the platform accessible on the website www.cars.coffee (the “Platform”), owned and managed by Cars and Coffee S.r.l. (“C&C” or “we”, “us”, or “our”).

You can browse the Platform in private mode (i.e. without signing up and creating an account) or signing up to the Platform, providing the personal data required in the registration form and creating your personal account.
By browsing, signing up or logging in to Platform, you acknowledge that you have read, understood and agreed to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform. We may update and modify the Terms from time to time. Your continued use of the Platform means that you have accepted those modifications.

C&C authorizes you to use the Platform for personal purposes only. Any reproduction of the content of the Platform that is not for personal use is forbidden. No reproduction of all or part of the content of the Platform can be sold, distributed or anyhow used for commercial purposes, nor modified or incorporated in any other work or publication.
The direct access to third parties’ websites or applications from links published on the Platform does not imply that C&C shares or approves the content of such websites and applications, that are not subject to any control of C&C. The access and use of such websites and applications will be governed by their respective terms and conditions and privacy policies.

All proprietary marks identifying the Platform and C&C are exclusively owned by C&C or, in some specific cases, by the Organizers, as defined below. You will not be allowed to use or reproduce such proprietary marks.

2. SIGNING UP TO THE PLATFORM

You can sign up to the Platform clicking on the “login” button on the top of the Platform homepage and then on “sign up”. You will have to fill the form with the required personal data, including your e-mail address. You will then receive an e-mail with a link to activate your new account.

Each user is allowed to create only one account for his/her personal use and shall not provide any false or inaccurate data or data belonging to third parties. C&C reserves the right to close and cancel all the accounts created in violation of such provisions.

Signing up to the Platform allows you to receive C&C newsletters and to register to the events organized and managed under the brand of C&C (“Events”).

3. EVENTS

You can see the list of Events on the “Find Events” page of the Platform. Such Events are organized by different entities worldwide (the organizing entity of each Event are hereinafter referred to as the “Organizer”).

By clicking on the name or picture of each Event you are redirected to a dedicated page which indicates date, place, Organizer and other main features of such Event. The page also specifies if the admission to the Event is free or subject to the payment of a fee. Such fee will be paid to the Organizer, in the way specified in Article 4. below.

If you wish to participate in an Event, you will need to log in to the Platform and register to the relevant Event by the indicated deadline. In order to do so, you will have to click on the “participate” button in the page of the Event and provide the information required. If the Event is a paid Event, you will have to pay the admission fee. The registration to the Event will be confirmed only at the receipt of payment. Only users that registered to the Event through the Platform will have the right to participate in the Event. By registering to an Event you accept and agree to any and all specific terms and conditions and other specific requirements provided by the Organizer and indicated in the page of such Event.

The Platform is only a means by which the Events are published and promoted. The organization and management of the Events is under the exclusive control of the entity indicated as organizer in the page of the Event. The Organizer shall be the sole responsible in relation to the organization and management of the Event and you acknowledge that C&C shall not be held responsible for the organization and management of the Events, or for any error or inaccuracy in the information relating to place, date, time, admission fee, specific requirements and other details of the Event published on the Platform. During your participation in the Event, you shall conform to all instructions provided by the Organizer.

4. PAYMENTS AND INVOICING

If the participation in an Event is subject to the payment of an admission fee, you will make the payment following the instructions provided at the time of registration. You will be required to pay either by credit or debit card or by other means, depending on the Event.

In case of payment by credit or debit card, the relevant invoice will be immediately available on the Platform for download. In case of payment by other means, the relevant invoice shall be sent by e-mail to the registered user at the time of receipt of payment. In any case, you will be responsible to provide correct and accurate invoicing information.

5. UPLOADING OF CONTENT

C&C and/or the Organizer may make videos and take pictures of the people and the cars participating in an Event. By registering to and participating in an Event, you authorize C&C to (i) publish the pictures and videos of you and your car on the Platform and on C&C’s pages on social medias and (ii) to distribute such pictures and videos to partners of C&C for the publication and reproduction in other webpages, social medias and other channels.
You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any pictures and other contents covered by intellectual property rights that you upload on the Platform.
You will not upload content or take any action on the Platform that infringes or violates someone else's rights or otherwise violates the law. We can remove any content you upload on the Platform if we believe that it violates the law, these Terms or our policies.

6. INFRINGEMENT AND REPORTING USER CONTENT

If you believe that any content uploaded on the Platform infringes your rights, please report it to C&C sending an e-mail to hello@cars.coffee. If C&C is notified by a third party that any content infringes his rights, C&C may in its absolute discretion take actions without prior notification to the provider of that content.

7. RESPONSIBILITY

C&C shall not be held liable for any damage deriving from your use of the Platform, including, without limitation, damages caused by errors, inaccuracies, interruptions, defects, cancellations, loss of data, unauthorized access, viruses or other losses.
The information that are published on the Platform are provided on an “as is” basis, without any warranty, express or implied. Therefore, C&C shall not be held liable for any inaccuracy contained in such information.

8. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed and take effect in accordance with the laws of Italy.
All disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Courts of Turin, Italy.
